Domestic violence and abuse can happen to anyone. It is not limited to physical violence and may include emotional or psychological abuse, coercive or controlling behaviour, financial abuse, intimidation, threats, or other forms of harmful behaviour.
If you are experiencing domestic violence or abuse, you have the right to live safely and free from harm. You should never feel that you must stay in an abusive relationship because you are worried about your immigration status.
Can You Keep Your Pre-Settled Status?
If you have been granted pre-settled status under the EU Settlement Scheme as the family member or joining family member of an EEA national, you can usually keep your pre-settled status even if your relationship has ended.
You may also remain eligible to apply for settled status once you have completed your continuous qualifying period in the UK.
Can You Apply for Settled Status?
You may be able to apply for settled status if your relationship with your eligible family member has permanently broken down because of domestic violence or abuse that took place while you were living in the UK.
Do You Need to Tell the Home Office Straight Away?
No. If your relationship ends because of domestic violence or abuse, you do not normally need to submit a new immigration application or notify the Home Office immediately.
However, when you later apply for settled status, you will need to explain the circumstances of your relationship breakdown and provide evidence that you have retained your right of residence.
